Report from the 2015 Winner of Young Lawyers Award on Placement in Miller Rosenfalck, London

During my placement I had an opportunity to examine some legal issues which can arise within the jurisdiction and to learn about the approach local lawyers have to handle them. Although the term of the placement was not long, it covered wide range of legal areas, including litigation, commercial and corporate as well as employment matters.
I started my placement by studying already closed court cases to examine the proceeding in the London Court of International Arbitration as well as the case law connected with the enforcement of court judgements delivered in other EU member states in England. Colleagues also shared with me several other closed files which enabled me to get the overall picture of handling matters as well as to learn about some details of advice given on contractual matters and the process of establishing business entity in England.
Several pending matters gave me an opportunity to provide my general comments. One of the most interesting ones involved possible dispute between contracting parties in the absence of a formal written agreement. The matter presented an excellent opportunity to examine provisions of international private law on EU and worldwide levels as well as the English case law with respect to the rules of conflict of law concerning choice of law and jurisdiction.
While examining several employment and corporate matters I had a chance to learn about some legal concepts unfamiliar to Ukrainian law as well as the legal arrangements implementing EU law, e.g. TUPE transfers. The possibility to use local information and legal resources of the hosting firm was helpful in finding more information on these aspects of the European law.
In my opinion, such placements present a good opportunity for young lawyers to enhance their general understanding of basic legal principles on which a certain legal system is based. Consequently, it contributes to better and more comprehensive understanding of any, including domestic, system of law.
