EU Regulation concerning matters of succession

In 2012, the EU published a new regulation (no 650/2012) with respect to matters of succession. The regulation applies to all Member States within the EU (with the exception of Denmark, United Kingdom and Ireland) and also applies to the rules of succession for a deceased person, on or after 17 August 2015. The regulation addresses various issues such as jurisdiction, applicable law, recognition, enforceability and the enforcement of decisions.

In accordance with the regulation, the general rule is that the applicable law regarding succession as a whole shall be the law of the State in which the deceased had his or her habitual residence at the time of death. In some countries, for example, Sweden, this involves a transition from the principle of nationality to that of domicile. An exception to this general rule is that any person may choose the applicable law to govern his or her succession as a whole. This can be the law of the State whose nationality he or she possesses at the relevant time or at the time of their death. The choice shall be made expressly in the form of declaration by way of disposition of property upon death or shall be demonstrated by the terms of such a disposition.

The regulation also introduces a European Certificate of Succession that may become of great practical significance. This certificate may be used by heirs, beneficiaries, executors of wills or administrators of estates in order to show their status/authority or that they have been assigned with a specific asset. A European Certificate of Succession has a legal effect in all Member States without the need for any special procedure being required.

EU-förordning om internationell successionsrätt

År 2012 publicerade EU sin nya förordning (nr 650/2012) om internationell successionsrätt. Förordningen gäller inom alla EU-länder (förutom Danmark, Storbritannien och Irland) och tillämpas på arv efter personer som avlidit den 17 augusti 2015 eller senare.

Enligt förordningen ska tillämplig lag på arvet i dess helhet som huvudregel vara det lands lag där den avlidne hade sitt hemvist. För till exempel Sveriges del innebär detta en övergång från nationalitetsprincipen till domicilprincipen. Som undantag till denna huvudregel kan arvlåtare genom testamente göra ett lagval om tillämplig lag. Vid lagval får arvlåtaren välja lagen i det land där arvlåtaren är medborgare vid tidpunkten för sitt val eller vid sin död. Lagvalet ska anges uttryckligen i ett testamente eller ett arvsavtal eller indirekt framgå av villkoren i ett sådant.

En annan viktig nyhet som kan få stor praktisk betydelse är att förordningen inrättar ett europeiskt arvsintyg. Detta intyg kan användas av arvingar, testamentstagare, testamentsexekutorer och boutredningsmän för att i andra medlemsländer visa sin ställning eller befogenhet eller att man blivit tilldelad en viss tillgång. Arvsintyget har rättsverkningar i alla medlemsstater utan att det krävs något särskilt förfarande.
